These Terms and Conditions ("Terms") govern your use of the website located at www.germantownconcretecompany.com (the "Site") and any services provided by Custom Germantown Concrete ("Company," "we," "us," or "our"). By accessing the Site or requesting services, you agree to be bound by these Terms.
By using this Site or engaging our services, you confirm that you are at least 18 years of age and have the legal authority to enter into agreements on behalf of yourself or the property owner. If you do not agree to these Terms, please do not use the Site or request services.
Custom Germantown Concrete provides residential and commercial concrete contracting services, including but not limited to driveway installation, patio construction, sidewalk work, foundation services, and related concrete work. All services are subject to a written agreement or estimate accepted by the customer before work begins.
Estimates provided by Custom Germantown Concrete are based on an in-person site assessment and reflect the scope of work described at the time of the estimate. Estimates are valid for 30 days from the date issued unless otherwise noted. A written estimate must be signed or accepted in writing by the customer before work begins.
If conditions discovered during the work differ materially from those observed during the estimate - such as hidden underground obstructions, structural issues, or soil conditions not visible at the surface - we will stop work and notify you before proceeding. Any change to the original scope of work requires written agreement from both parties.
Project scheduling is confirmed after estimate acceptance. Start dates are subject to weather conditions, permit timelines, and crew availability. We will notify you as soon as reasonably possible if a scheduled date must change.
If you need to cancel or postpone a scheduled project, please notify us at least 48 hours in advance. Cancellations made less than 48 hours before a scheduled start date may result in a fee to cover mobilization costs already incurred.
Payment terms are specified in the written estimate or project agreement. A deposit may be required before work begins, with the remainder due upon project completion unless other terms are agreed to in writing. Payment is due in full upon completion unless a payment schedule has been established in writing.
Accounts that remain unpaid beyond 30 days of the invoice date may be subject to a late fee and referred to collections. The customer is responsible for any reasonable collection costs, including attorney fees, if legal action becomes necessary to collect an outstanding balance.

We are not responsible for delays or damage resulting from the customer failing to complete these responsibilities before the scheduled start date.
Where required by local ordinance, Custom Germantown Concrete will obtain the necessary building permits before beginning work. Permit fees are the responsibility of the customer and will be included in the written estimate. Work will not begin until required permits are obtained.
Custom Germantown Concrete warrants that all work will be performed in a professional and workmanlike manner consistent with industry standards. Any warranty terms specific to a project will be stated in the written estimate or project agreement.
Warranty coverage does not extend to damage caused by factors outside our control, including but not limited to: customer failure to follow care instructions, use of deicing chemicals not recommended for concrete, soil movement beyond normal settlement, flooding, or other acts of nature.
To the fullest extent permitted by law, Custom Germantown Concrete's liability for any claim arising from services provided shall not exceed the total amount paid by the customer for the specific work giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or loss of use.
In the event of a dispute, the parties agree to first attempt to resolve the matter through direct communication. If a resolution cannot be reached within 30 days, either party may pursue mediation before initiating formal legal proceedings. Nothing in this section limits a party's right to seek injunctive relief.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law provisions. Any legal action arising from these Terms or from services provided by Custom Germantown Concrete shall be brought in the appropriate courts of Maryland.
